There is a systematic discrimination in our criminal justice system. According to Walker, Spohn & DeLone (2011), there is solid evidence of discrimination in numerous stages of the process of criminal justice, encompassing the use of deadly force by the police on minority groups and the application of the capital punishment. Also, Walker, Spohn & DeLone (2011) cite that ethnic/racial groups are treated more harshly in comparison to whites at some stages in the system.
The Arizona Bill 1070 is legislation that makes it a state misdemeanor crime for an immigrant to be in Arizona State without carrying the necessary documents and compels the police to try, when reasonable in a “legal stop, arrest or detention” to establish the immigration status of an individual if there is rational suspicion that the person is an unlawful immigrant (Magaña & Lee, 2013). The bill led to a considerable number of immigrants to leave and/or contemplate leaving Arizona. The enactment of the bill also led to a reduction in the usage of public assistance and preventive healthcare for fear of deportation. Immigration lawsuits also arose. As such, a number of Arizona law enforcers sued the state alleging that they are required to implement a law that could possibly cause liability on themselves.
System discrimination denotes to a method of prejudice that occurs often in the criminal justice system as an innate part of the system through processes and interactions leading to the creation of a disadvantage for individuals with common set features like gender, race and disability over a prolonged period. Examples include punishing Black Americans in a much more aggressive manner compared to white people, using deadly force on Latinos and Blacks on police stops, etc.
