Legalization of Same-Sex Marriage
Same-sex marriage also termed as gay marriage is the marriage between two couple of same-sex either in religious or civil ceremony setting. The topic of same-sex marriage has heated since the 20th century about the legality of the marriage as well as the sacredness of marriage (Gerstmann. 7). The opposing views from diverse religious groups, political elites, and individuals, as well as psychologists, have left this topic with massive controversies. Same-sex marriage ought to be permitted in all states. This can be attributed to the advantages drawn from the act of marriage. Despite this, the opponents base their arguments on religious grounds and the sacredness of life. However, legalizing same-sex marriage will lead to love and peace in the nation, protection of individual’s rights, and also enjoying a longer lifetime.
In the Fourteenth Amendment to the US constitution, all citizens are guaranteed to equal protection from all government agencies irrespective of their gender, sex, race, color, or religious backgrounds (Arango). By making same-sex marriage legal, the US government will be protecting the rights of the gay people in the nation. On the other hand, illegalizing the gay marriage will lead to discrimination of the gay people. Just like the heterosexuals, the gays have equal opportunities, equal rights and also have the same privileges accorded in the US constitution. Denying them their right to marriage will be depriving them their fundamental rights as American citizens. Both the 14th and the Fifth Amendments of the US constitution also accords the citizens the due process of the law which asserts that the federal government will deny no personal liberty, life or property outside the constitutional provisions (Arango). As a result of the due process, both the gay people and the heterosexuals ought to enjoy the same privileges as stipulated in the constitution. Thus, in regard to the US constitutional rights and the due process stipulated in both the 14th and 5th Amendments of the US constitution, the gay people ought to be allowed to enjoy their lives without interference or inhibition from the government.
Additionally, the debate on same-sex marriage emanates from the idea that the government ought to protect or preserve the sanctity of marriage and also regard or view marriage as a sacred trust provided by God (Gerstmann. 14). The government has nothing to deal with the cared trust and sanctity of marriage at all. According to the government, marriage is a secular institution. The government does not determine the sacredness of life. Though the Federal Marriage Act demands that marriage ought to be between a man and a woman, the Civil Unions, on the other hand, is an essential step towards the end of discrimination against the lesbian and gay couples (Arango). The Civil Unions has a particular category of protection and rights for lesbian and gay couples. The Lesbian and gay Americans serve in the national military, serve as firefighters and police officers, pay taxes, build cities and also work as hospital staffs. Lesbian and gay couples should not be denied legal rights in health insurance, inheritance, and pensions as the heterosexual couples enjoy.
Furthermore, as asserted by Kant, treating people as ends themselves not as a means to an end is ethical. Kant also contends that an individual is evil or noble subject on his or her motivation for their actions but not on the outcomes or consequences of those actions. “An aim is not intended to produce pleasure or happiness but instead to produce goodwill or kind” (Kant. Pp. 19). Legalizing same-sex marriage will be treating the gay couples as ends themselves not means to the ends hence being ethical. Also, the core objective of legalizing same-sex marriage is to ensure that the gay couples enjoy life and also become happy in the long as their heterosexual counterparts. All humans need love, care, happiness, and also the feeling of having a family. The motivation for doing something but not the results or consequences determines if it is ethical. The core motivation for legalizing same-sex marriage is to ensure peace, happiness and love prevail in every individual’s life.
Same-sex marriage does not also hurt the heterosexuals in the long run (Arango). Each culture has its social norms. For instance, Catholic families raise their children as per the church teachings. Heterosexual marriages have suffered various setbacks such as divorce. Since the same-sex marriage has not been in existence for so long, we cannot know their implications; we ought to give a chance for the gay people to engage in their matrimonial unity. Their marriage will not impact the heterosexual marriages at all.
Marriage is also about commitment and love (Arango). If the gay couples are in love and committed to each other, then there is no point in denying them their chance to live together, enjoy the constitutional privileges and rights.
Despite this, the opponents of same-sex marriage assert that it is against the will of God. According to the Hebrew creation myth, God created man and woman so that they can marry and sire children (Rogerson). When Sodom and Gomora practiced homosexuality, God punished them by sending down fire of Sulphur. God’s wrath is adverse. Thus, legalizing same-sex marriage will lead to the promotion of act of homosexuality and lesbianism. This will lead to God’s wrath which will cause massive panic amongst humanity. Therefore, the government ought not to legalize same-sex marriage.
Same-sex marriage would also undercut the social norm of sexual fidelity within the marriage context. Marriage is sacred, and it is meant for man and woman who are engaged sexually (Arango). Same-sex marriage reduces the fidelity of faithfulness, commitment, and love. This, in turn, will reduce or undercut the norms or perceptions of marriage fidelity which entails the virtues of love, commitment, and faithfulness. In the long run, the same-sex marriage will corrupt the morals of the society.
In conclusion, the debate about same-sex marriage has raised diverse points of view from both the Federal judicial system, psychologist, and individuals. The proponents are arguing that illegalizing same-sex marriage will deprive the gay and lesbian couples their constitutional rights and also violate America’s basic principle of democracy as stipulated in the civil unions and both the 5th and 14th Amendments of the constitution. However, the opponents assert that legalizing same-sex marriage will lead to a violation of God’s creation and also undercutting of marriage sexual fidelity. Moreover, based on the rights and privileges accorded in the US constitution, it is both ethical and lawful to protect and preserve the rights of all the American Citizens thus same-sex marriage ought to be legalized.
