Differences between the Legal and Ethical Considerations for Group / Family Therapy vs. Individual Therapy

Introduction

Ethical considerations in therapy involves professional boundaries, confidentiality and privileged communications. There are five ethical principles that guide the practice of Psychotherapy. These include autonomy, beneficence, fidelity, justice and non-maleficence (Center for Substance Abuse Treatment, 2000). Additionally, ethical considerations in therapy also relates to treatment integrity and therapist competence. (Srinath & Bhola, 2016: 2024 – Do my homework – Help write my assignment online). The psychotherapist must be knowledgeable of the State and Federal regulations overseeing his/her practice and strive to uphold such professional standards. Scott, (2000). Therefore, adhering to the legal and ethical framework is crucial during any therapy session because the guidelines are applicable to all types of therapy whether it’s individual, group or family therapy.

Individual Therapy

Individual therapy relies on the development of a One & One relationship between the therapist and the patient. Disclosing private information without the patient’s consent can be detrimental to the therapeutic relationship. (McClanahan, 2014: 2024 – Essay Writing Service | Write My Essay For Me Without Delay). A professional therapeutic relationship requires the buildup of trust and confidence between the therapist and the patient. This allows the patient to be at ease and also facilitates the willingness to reveal bothersome information to the therapist. The relationship can assume different forms depending on the therapist focus. In so doing, the relationship could shadow one of personal development or simply symptoms reduction. It cannot be overstated, but in individual therapy, ethical and legal considerations play an oversize role. The parties involve must pay close attention to the following principles – the disclosure of the overall nature of the therapy, informed consent, understanding of the confidentiality agreement and its’ limit as it relates to therapeutic boundaries as well as the limitation of the therapeutic relationship and responsibilities of parties involved. (Mignone et al, 2017). It should be noted that during the individual therapeutic sessions, the patient could be untethered when discussing troublesome issues since there is no outsiders in the room.

Group and Family Therapy

The legal and ethical considerations for group and family therapy are very different from those that apply to individual therapy largely because it is more difficulty to maintain confidentiality in a group setting. Maintaining confidentiality in a group/family therapeutic setting can prove very difficult because of multiple individuals’ involvement. Studies have shown that group members expect complete privacy even though maintaining complete confidentiality within a group cannot be guaranteed. (McClanahan, 2014: 2024 – Essay Writing Service | Write My Essay For Me Without Delay). However, to maintain confidentiality within a group / family setting, the group leader will be required to clearly define what constitutes a breach of confidentiality and openly discuss the consequences of breaking the terms of the confidentiality. (McClanahan, 2014: 2024 – Essay Writing Service | Write My Essay For Me Without Delay). Group/Family therapy rests on the dynamic interaction of the members of the group and places emphasis on assisting participants understanding why they project certain behaviors toward others, and at the same time learn from the feedback that was acquired. Group therapy has several goals which aim at facilitating the patient’s comfort and growth within the group development. In group/family therapy, effective relationship and interpersonal skills can be learned from helping individuals learn from behaviors that were corrected. Group therapy is particularly essential in the treatment of PTSD, Anxiety, Depression and other behavioral health issues including substance abuse disorders. It provides a solution to the increasing demand for behavioral therapy by permitting the treatment of numerous individuals simultaneously. (Malhotra & Baker (2019: 2024 – Online Assignment Homework Writing Help Service By Expert Research Writers).

Impact of Different Therapeutic Approaches for Clients in Group / Family Therapy

The transition from Individual to Family therapy would impact my documentation and note keeping approaches. I am very much aware that my psychotherapy notes should not be publicized or viewed by any individual other than the therapist. Therefore, it would be necessary for me to maintain separate documentation. The idea is to separate these notes from the rest of a patient’s medical records even those that are kept in the electronic record system. Additionally, these notes should be restricted and not be used as regular medical records or any other source of information that would normally be revealed during health care operations, treatment or payment matters. These notes should have little or no use to another individual who was not a party to the therapy session. (Corley, 2013). As the therapist, it is very important to be upfront from the initial interaction with all involved and alert them of their rights to confidentiality. Make them aware that as the therapist, I cannot disclose to other family members any information that was shared in private (American Association for Marriage & Family Therapy, 2011). I would be very professional in addressing the group as a whole and avoid focusing on the patient.
