Assume for purposes of this discussion that the state university’s actions constitute state action. Smith for burglary and having stolen things because they were afraid he would get rid of the things before they could come back with a search warrant. The state and federal courts upheld Mr. Smith’s convictions, and the case is now before the U.S. Supreme Court. Prepare the Court’s answer to Mr. Smith’s claim that his constitutional rights were violated.
