The incident occurred last month during a period of intense production in the factory.

The facts are as follows…  Squelch Drinks Ltd (Squelch) is a small, unlisted Australian public company that manufactures a range of supermarket beverages marketed under different product labels (for e.g. the “Weekly Juice Company” orange ju ice which is surprisingly popular amongst customers).  Jennifer is a director of Squelch and is also responsible for the company’s production line and related operations. On the day of the incident last month, when Squelch’s factory was operating at maximum capacity, some key production machinery stopped working. A technician employee at Squelch, Leonard, was on duty at the time and was instructed by Jennifer to inspect the faulty machinery.

Leonard had to physically move within the broken-down machinery to resolve the problem.  After a couple minutes or so of work, Leonard called out to Jennifer and other employees that he had fixed up the problem and that he was “coming out”. Upon hearing this, Jennifer gave instructions to the machine operator to turn the machines back on, to “get on with production” – it is well known that this particular machine usually takes several minutes to warm up.  The machine operator refused to restart production though until Leonard was safely outside the machine. Jennifer then reached for the restart button herself and commented, “there’s plenty of time for him”.

Unfortunately for Leonard however, he was suddenly distracted by a social media post on his phone (he had thought it might be important) which delayed him from exiting the machine in a safely and timely way. The machine also apparently started up quicker than usual due to it being unusually warm. Leonard became trapped inside and sustained serious injuries.

It appears that the incident is an industrial “accident”, although following the company’s internal investigation, a couple of employees claim that they heard Jennifer later say to Leonard, “hell hath no fury like a woman scorned”   Your team is tasked with advising ASIC as to what might be the possible corporate liability of Squelch Ltd for Leonard’s injuries.  Please advise ASIC re company law as follows: The general circumstances when a company becomes liable in TORT and CRIMINAL law for actions of its participants Whether your team thinks that Squelch Ltd might possibly be liable for Leonard’s injuries.   Business Law Assignment: I need help writing a research paper.
